According to the GPL v2 we have then done everything we need to. Paragraph 1: Then, regarding a transfer of Copyright under USA law: Should the new 17 USC 203: When we recieved the license and started the GrandOrgue code branch from MyOrgan, the copyright and trademark were still legally owned by Kloria, so this has to be reflected in our statement. This is not a legal oppinion as I'm not a lawyer, but it seems sensible to me. |

Originally posted 2009-08-25 20:56:43 by isotherm in GrandOrgue discussion forum on SourceForge The two copyrights at work here are: the original MyOrgan 1.0.6 source code; and I cannot provide legal advice either, but I do know that "Copyright (C) 2006 Kloria Publishing LLC" is no longer a valid copyright notice; I have irrevocably transferred the copyright to Milan Digital Audio LLC. The holder of the copyright when the GrandOrgue project began is immaterial; there is only one copyright for the original source code, which is now held by a different party. Since the GrandOrgue project has no license to use the Kloria Publishing trademark, I request that you either omit the misleading 2006 notice entirely, or provide an accurate acknowledgment of the current copyright holder. In making that choice, I would advise that you consult with them in order to determine their preferences. Finally, please remove the file "Emails from KM about MO.txt" from the source code tree. These were personal emails, not intended for any kind of distribution, and certainly not suitable to be intermingled with source code. Their presence in the SVN tree is unacceptable. So then, here is the summary of what I hope will be changed, so that I need not bother the project any more:
I hope that you will see to the timely removal of these items, so that no further action is warranted. Thank you! |

Here is an email I received from Kirk Meyer Kloria Publishing:
"Developers,
I notice that the following has appeared in the GrandOrgue source code:
"Copyright (C) 2009 GrandOrgue team - free pipe organ simulator based on MyOrgan Copyright (C) 2006 Kloria Publishing LLC"
However, this is not a valid copyright notice, and your project is not licensed to use the "Kloria Publishing LLC" trademark. Please remove all references to "Kloria Publishing LLC" from the project. Neither I nor Kloria are associated with the project in any way. Continued misuse of the trademark will constitute trademark infringement.
Furthermore, you are hereby notified that both the MyOrgan copyright and trademark have been fully and irrevocably transferred to Milan Digital Audio LLC. You may wish to consult with them to be sure your use of the MyOrgan trademark and lack of proper copyright notice are acceptable to them.

Not sure what we should do or want to do.
Because we are not in the business of tracking who are the owners of trademarks and copyrights, we might be just OK to keep the "Copyright (C)" without specifying the copyright owner. In any case, I believe Copyright of a previous branch has little vale due to the GPL nature of the license. We might be just OK referring to MyOrgan which is indeed the GPL project we used to branch.
