US Government Data is available for free per the Copyright Act of 1976. Which specifies that no work of the US Government may be copyrighted. It's 1977 amendment states that the only copyrightable works of the US Government or its agencies that is copyrightable are stamps created by the US Postal Service created in 1977 or later.
