Even though 3.12 is early alpha, I'm raising this deprecation warning in pip so it can be tracked somewhere.

The usage of rmtree in this function https://github.com/pypa/pip/blob/main/src/pip/_internal/utils/misc.py#L130 raises the exception. This argument was only introduced in 3.12, so a patch wouldn't be backward compatible. https://docs.python.org/3.12/library/shutil.html#shutil.rmtree

@tonybaloney I've created a small fix for this over in #12137 I'm not seeing any issues on my side, but any chance you're able to verify given that you appear to be running various alpha versions.
